For practical advice about transactions, scams, and reporting, visit our Safety guide.
1. Operator, agreement, and eligibility
Johny’s List (johnyslist.com) is operated by Exclusive Homes LLC dba SINTELIUM, based in St. Thomas, U.S. Virgin Islands, (“SINTELIUM,” “we,” “us,” “our,” or “Operator”). These Terms govern the marketplace services you affirmatively agree to use. Our Privacy Notice explains our information practices; accepting these Terms is not consent to optional advertising tracking.
You must be at least 18, have reached the age of legal majority where you reside, and have legal capacity to enter this agreement. If acting for a business, you must have authority to bind it. If you do not agree, do not use posting, messaging, or paid marketplace features. You may still read these policies and contact support.
2. We provide a platform, not the transaction
We host user-created listings and communications. Unless a separate written agreement expressly states otherwise, we are not a buyer, seller, lessor, tenant, employer, recruiter, broker, agent, dealer, inspector, payment intermediary for member transactions, escrow service, insurer, or party to an agreement between users. Hosting a housing listing does not establish an agency or brokerage relationship with the Operator.
We do not take possession of listed goods, inspect them, test whether they work, authenticate them, verify ownership or liens, conduct background checks on every user, or guarantee that a listing, person, business, professional credential, or offer is accurate, safe, legal, available, or genuine. Search rankings, approval, moderation, a profile, an advertisement, and a Featured badge are not certification or endorsement.
3. Sellers and advertisers are responsible for their offers
You must own or have authority to offer what you list and provide truthful, current descriptions, prices, photos, availability, and contact details. Disclose known material defects, nonworking parts, damage, recalls, safety issues, title problems, liens, and other facts that a reasonable buyer needs. Do not describe a nonworking item as working, conceal defects, impersonate another person, or use photos or intellectual property without permission.
You are responsible for your promises, warranties, licenses, professional qualifications, taxes, fees, permits, required disclosures, consumer remedies, and compliance with laws governing your item or activity. Housing, employment, services, animals, vehicles, boats, and business sellers may have additional legal obligations. These Terms do not authorize an unlawful sale or excuse a seller from liability for fraud or nondisclosure.
4. Buyers must independently evaluate the transaction
Before committing, verify the other party’s identity and authority, inspect and test the item, confirm specifications, condition, ownership, title, liens, authenticity, and compatibility, and obtain professional inspections or advice when appropriate. Agree directly on price, payment method, inspection, pickup, shipping, installation, warranties, returns, cancellations, and refunds. Keep your own records.
Users—not the Operator—arrange and perform their transaction. We do not promise buyer protection, payment recovery, item refunds, replacement, repair, delivery, or compensation for a member’s conduct. An item that does not work, differs from its description, never arrives, or becomes defective is ordinarily a matter to resolve with the seller and any applicable payment provider or authority. Your nonwaivable rights against the seller, payment provider, or Operator remain intact.
5. Transaction risks and safety
You decide whether to communicate, meet, buy, sell, rent, hire, or provide services. These activities carry risks including defective or unsafe goods, counterfeit or stolen property, fraud, failed payments, identity misuse, damage, injury, and unlawful conduct. To the extent permitted by law, you assume the ordinary risks of your voluntary interactions and independently arranged transactions.
Meet in a safe public place when appropriate, inspect before paying, and avoid advance payments to unknown people. A listing is not a reason to ignore warning signs. Report suspected abuse through the listing report function or support@johnyslist.com. For emergencies, contact local emergency services; the site is not an emergency response service.
6. Accounts and communications
Keep your account information accurate and credentials secure. Do not share an account to evade restrictions, create deceptive identities, or use another person’s account. Tell us promptly about suspected unauthorized access. You are responsible for activity you authorize, but nothing here automatically makes you liable for every unauthorized act regardless of fault or applicable law.
Listing contact information is public except when you choose to hide your email address. Private email aliases forward inquiries to your verified account email and relay replies; the relay hides both participants’ real email addresses from each other. Do not include private contact details in message text or signatures if you want them kept private. Communicate lawfully and respectfully. Do not send spam, phishing, threats, harassment, unlawful discrimination, or requests for unnecessary sensitive information. In-app messages are not represented as end-to-end encrypted and may be accessed when reasonably necessary for support, abuse investigation, legal obligations, or operating the service as described in the Privacy Notice.
7. Prohibited content and conduct
Do not offer illegal, stolen, counterfeit, recalled, or unlawfully dangerous goods; weapons, ammunition, explosives, controlled substances, prescription drugs, sexual services, trafficking, or material exploiting children. Do not facilitate fraud, gambling without lawful authorization, financial scams, or infringements of privacy or intellectual property. We may prohibit additional categories of high-risk content even if lawful in some places.
Do not discriminate unlawfully in housing, employment, or any other offer. Do not bypass moderation, posting limits, access controls, or payment requirements; scrape personal data; publish malware; manipulate search or ad performance; or interfere with the service. Advertising must be truthful and properly authorized.
No harassment, stalking, intimidation, hate-based abuse, sexual harassment, unsolicited explicit material, threats, doxxing, impersonation, blackmail, or sharing intimate images without consent. Do not publish someone else’s private contact information, identity documents, financial information, or messages without a lawful basis. Never post sexual content involving minors or seek to exploit or traffic a person.
We also prohibit human organs or bodily fluids; hazardous waste; unlicensed medicines; alcohol, tobacco, nicotine and vaping products; endangered wildlife or prohibited animal products; forged documents or credentials; stolen accounts or access codes; pyramid schemes; deceptive investment or get-rich-quick offers; and unauthorized sales of benefits or financial accounts. Pets and animal listings must be lawful, humane, truthful, and comply with applicable licensing, transport, and welfare requirements. A category being available is not permission to list prohibited goods.
Do not publish discriminatory housing or job advertisements or unlawful screening requirements. Describe the property, role, and lawful qualifications rather than excluding people based on protected characteristics. Do not request money for a fake job or misrepresent professional licensing. Remove unavailable offers and do not flood categories with duplicates, misleading prices, unrelated keywords, or disguised advertising.
Without permission, do not harvest contact information, bulk-download or republish listings, use automated accounts to spam people, or circumvent technical restrictions. Ordinary search-engine indexing of public pages in accordance with our published crawler instructions is permitted. Do not use our name, icon, or branding to imply affiliation or approval.
8. Your content and our limited license
You retain ownership of content you submit. You grant the Operator a nonexclusive, worldwide, royalty-free license to host, store, reproduce, resize, format, transmit, and display it as reasonably needed to operate, secure, moderate, and present the marketplace and your listing, including through our service providers. You represent that you have the necessary rights and permissions.
The license for public display ends when your content is removed from public view, except for copies already distributed, reasonable backup and recordkeeping, legal obligations, dispute handling, and technical removal delays. This does not give us unrestricted ownership of your content or permission to publish private messages as advertisements.
9. Moderation, suspension, and availability
We may review, flag, refuse, limit, remove, or disable content or accounts for suspected violations, safety concerns, legal requirements, or service integrity. Automated tools and human review can make mistakes and do not identify every problem. Voluntary moderation does not guarantee an item’s condition, a user’s trustworthiness, or that every listing is lawful.
We may preserve relevant records, respond to lawful requests, and cooperate with authorities when appropriate. Contact support to contest a decision. We may change or discontinue features or suspend access as reasonably necessary, subject to applicable law and obligations relating to paid services. The site may experience outages, delays, lost communications, or errors.
10. Free listings, featured upgrades, and advertising
Ordinary listings are free. Optional featured upgrades have the price and duration disclosed before checkout, are for the selected listing, and do not renew automatically. PayPal processes these platform-service payments under its own terms. We do not process the underlying purchase price for transactions between members.
A paid feature buys promotional placement for its stated period, not guaranteed views, leads, buyer quality, a sale, or exclusive placement. Payment does not override moderation. A sold, removed, or ineligible listing may stop appearing. To the extent allowed by law, delivered promotional services are nonrefundable solely because a listing did not sell or you changed your mind. Report duplicate charges, non-delivery, or billing errors promptly to support@johnyslist.com; we will investigate and provide any correction, refund, or remedy required by law or warranted by our failure to deliver.
Direct business advertising is governed by the placement, dates, price, cancellation, and other terms agreed in writing with the advertiser, together with these Terms where applicable. We do not promise impression or click counts unless expressly agreed. Advertisers remain responsible for their artwork, claims, destination sites, offers, and legal compliance. Ads are not endorsements.
11. Disclaimer of platform warranties
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE MARKETPLACE AND USER CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” THE OPERATOR DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NONINFRINGEMENT AS TO THE PLATFORM AND THIRD-PARTY CONTENT, AND DOES NOT WARRANT UNINTERRUPTED, ERROR-FREE, SECURE, ACCURATE, OR RELIABLE SERVICE.
THIS IS NOT A STATEMENT THAT EVERY SELLER’S GOODS ARE LAWFULLY SOLD “AS IS.” SELLERS REMAIN RESPONSIBLE FOR THEIR OWN WARRANTIES AND MANDATORY OBLIGATIONS. WE DO NOT DISCLAIM EXPRESS COMMITMENTS WE MAKE IN A SEPARATE AGREEMENT OR RIGHTS THAT APPLICABLE LAW DOES NOT ALLOW US TO EXCLUDE.
12. Release for disputes between users
To the fullest extent permitted by law, you release SINTELIUM, and its officers, employees, and agents from claims, demands, and damages arising out of disputes between you and another user or third party concerning independently arranged transactions, listings, item condition, payment, delivery, or third-party representations. This includes known or unknown transaction-related claims only to the extent such a release is lawful.
This release does not cover the Operator’s own fraud, intentional misconduct, gross negligence, breach of a nonwaivable duty, or any claim that cannot lawfully be released. It does not prevent reporting misconduct to authorities, cooperating with investigations, or asserting protected consumer rights.
13. Limits of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE OPERATOR AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, BUSINESS OPPORTUNITIES, GOODWILL, OR DATA ARISING FROM THE PLATFORM OR THIRD-PARTY TRANSACTIONS, EVEN IF ADVISED SUCH DAMAGES ARE POSSIBLE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR CLAIMS ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF US $100 OR THE AMOUNT YOU PAID THE OPERATOR FOR PLATFORM SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. PAYMENTS YOU MAKE TO OTHER USERS ARE NOT PAYMENTS TO THE OPERATOR.
These exclusions and the cap do not apply to fraud, intentional misconduct, gross negligence, liability for death or personal injury where limitation is prohibited, or other nonwaivable liability. They do not reduce statutory remedies or refunds that must be provided. If a restriction is unlawful in your jurisdiction, it applies only to the extent lawful.
14. Responsibility for third-party claims
To the extent permitted by law, you will indemnify and hold the Operator and its officers, employees, and agents harmless from third-party claims and reasonable resulting costs, including reasonable legal fees, to the extent caused by your unlawful conduct, material breach of these Terms, infringement of another person’s rights, or false or unauthorized listing or advertising content.
This obligation does not cover losses caused by the protected party’s own negligence, fraud, intentional misconduct, or legal violations. We will provide reasonable notice and cooperation; you may not settle a claim in a way that admits fault by or imposes obligations on us without our written consent. Any defense or settlement arrangement remains subject to applicable law.
15. Complaints, intellectual property, and support
Send legal, privacy, billing, or intellectual-property concerns to support@johnyslist.com. Identify the relevant listing or URL, your contact information, the issue, and supporting details without sending unnecessary sensitive documents. Rights holders should identify the protected work or right and the allegedly infringing material. We may request additional information and restrict repeat violations.
This contact process does not represent that a statutory copyright safe harbor or designated-agent registration has been completed. Nothing in these Terms restricts lawful reports to regulators, law enforcement, or a payment provider.
For a copyright complaint, identify the copyrighted work and each specific URL or item alleged to infringe; give your name, mailing address, phone number and email; include your physical or electronic signature; state that you believe in good faith the use is unauthorized by the rights holder, its agent, or law; and state that your information is accurate and, under penalty of perjury, you are authorized to act for the rights holder. Send the complaint to support@johnyslist.com. Knowingly false claims can have legal consequences.
We may remove or restrict challenged material, notify the uploader, and share the complaint information needed to address the claim. If you believe removal was mistaken, contact support with the affected URL, your rights or authorization, and supporting information. We will explain any applicable formal counter-notice process; sending an ordinary appeal does not itself create a statutory restoration deadline. We may terminate accounts of repeat infringers in appropriate circumstances.
For privacy abuse, threats, impersonation, or other safety concerns, include the listing URL or conversation identifier, relevant dates, and a concise description. Preserve evidence but do not send illegal imagery or unnecessary identity documents. Reporting and blocking tools are explained on our Safety page. Reports are reviewed as available, not as emergency dispatch.
16. Applicable law and resolving disputes
Contact support@johnyslist.com so we can try to resolve an issue. Informal contact is encouraged but does not suspend filing deadlines or remove your right to seek urgent relief, use small-claims procedures where available, or contact a regulator.
Subject to mandatory protections and conflict-of-law rules, these Terms are governed by the laws of the U.S. Virgin Islands and applicable federal law. Ordinary jurisdiction rules determine the proper court. Nothing deprives consumers of nonwaivable protections or courts available to them under applicable law, including in Puerto Rico. These Terms do not impose mandatory arbitration, a class-action waiver, a shortened limitations period, or an exclusive forum.
17. Changes and general provisions
We will identify revised Terms by date/version and seek renewed affirmative acceptance for material changes before continued use of features requiring agreement. Changes will not retroactively alter rights for earlier transactions where prohibited. The version accepted at the relevant time and applicable law determine existing rights.
If a provision is unenforceable, the rest remains effective to the extent lawful. Failure to enforce one provision is not a waiver. Provisions that by their nature must survive termination—including accrued payment obligations, lawful releases, liability limits, and dispute provisions—survive to the extent permitted by law. These Terms and applicable written service agreements form the agreement for their subject matter; mandatory law prevails.
